TERMS AND CONDITIONS

1. Scope
These terms and conditions apply to all orders placed via our online shop www.fistukidz.com by consumers and businesses.

3. Formation of contract
The presentation of products in our online shop constitutes a legally binding offer to conclude a purchase contract. You accept this offer by clicking the order button that completes the checkout ("Pay now"). You will receive an order confirmation by email immediately afterwards. All items are available only while stock lasts.

4. Contract language and saving of the contract text
The contract language is English. We save the contract text and send you the order details and these terms and conditions by email. You can also view your orders in your customer account, if you have created one.

5. Prices and shipping costs
All prices are final prices in euros and include statutory VAT. Shipping costs are added and shown before you complete your order (see our Shipping policy). For deliveries outside the EU, customs duties and import taxes may apply, which are paid by the recipient.

6. Delivery
We deliver to the countries shown at checkout. Delivery times are stated in our Shipping policy. Collection by the customer is not possible.

7. Payment
The payment methods available are shown at checkout, in particular:
- PayPal: payment is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, under the PayPal terms of use.
- Credit card, Apple Pay, Google Pay, Klarna and other methods via Shopify Payments: your payment is charged when the order is placed.
Payment is due immediately upon conclusion of the contract.

8. Retention of title
The goods remain our property until full payment has been made.

9. Right of withdrawal
Consumers have a statutory right of withdrawal of 14 days. This also applies to sale items. Details, including the model withdrawal form, can be found in our Refund / Cancellation policy.

10. Transport damage
If goods are delivered with obvious transport damage, please report this to the delivery agent as soon as possible and contact us. Failure to do so has no effect on your statutory rights.

11. Warranty
The statutory warranty rights apply. Complaints can be sent to the address above or by email to info@fistukidz.com. We will respond within 14 days.

12. Liability
We are liable without limitation for claims arising from injury to life, body or health, for intentional or grossly negligent breach of duty, for guarantees given, and where mandatory under the Product Liability Act. For slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable damage typical for the contract. Otherwise, claims for damages are excluded.

13. Consumer dispute resolution
We are willing to participate in dispute resolution proceedings before a consumer arbitration board: Allgemeine Verbraucherschlichtungsstelle des Zentrums für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, Germany, www.verbraucher-schlichter.de.

14. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence.
