1. Scope
The following terms and conditions apply to all orders placed via our online shop www.fistukidz.com.
2. Contractual partner, formation of contract
The purchase contract is concluded with fistukidz, Proprietor Gil Winzelberg, Holzhausenstr. 76, 60322 Frankfurt am Main, Germany.
The presentation of products in our online shop constitutes a legally binding offer. You accept this offer by clicking the order button that completes the checkout. You will receive a confirmation of your order by email immediately afterwards.
3. Contract language, saving of the contract text
The contract language is English. We save the contract text and send you the order details and these terms and conditions by email. You can also view your orders in your customer account, if you have created one.
4. Delivery conditions
Shipping costs are added to the product prices as shown at checkout. We ship with DHL. Collection by the customer is not possible.
5. Payment
The payment methods available are shown at checkout. These include in particular:
PayPal: You pay via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, under the PayPal terms of use. Payment is processed directly after the order is placed.
Credit card and other methods via Shopify Payments: Your card is charged when the order is placed.
6. Retention of title
The goods remain our property until full payment has been made.
7. Transport damage
If goods are delivered with obvious transport damage, please report this to the delivery agent as soon as possible and contact us. Failure to do so has no effect on your statutory rights.
8. Warranty and guarantees
The statutory warranty rights apply. Complaints can be sent to fistukidz, Holzhausenstr. 76, 60322 Frankfurt am Main, Germany, or by email to info@fistukidz.com. We will respond within 14 days.
9. Liability
We are liable without limitation for claims arising from injury to life, body or health, for intentional or grossly negligent breach of duty, for guarantees given, and where mandatory under the Product Liability Act. For slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable damage typical for the contract. Otherwise, claims for damages are excluded.
10. Consumer dispute resolution
We are willing to participate in dispute resolution proceedings before a consumer arbitration board: Allgemeine Verbraucherschlichtungsstelle des Zentrums für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, Germany, www.verbraucher-schlichter.de.
